Visual Sugar Creative

Welcome to Visual Sugar Creative. By engaging in services with Visual Sugar Creative (“Designer”), you (“Client”) agree to the following terms and conditions. These policies are in place to ensure a clear, professional, and mutually respectful working relationship.

1. Scope of Services

Visual Sugar Creative provides brand identity design, packaging design, and website design services for consumer packaged goods (CPG) and product-based businesses.

Each project scope, deliverables, timeline, and pricing will be outlined in a separate proposal or agreement. Any services not explicitly listed are not included.

2. Payment Terms

  • All projects require a non-refundable deposit to secure your project start date.

  • Remaining balances are due according to the payment schedule outlined in your proposal or invoice.

  • Final deliverables will not be released until full payment has been received.

  • Late payments may result in project delays.

3. Revisions Policy

Each package includes two (2) rounds of revisions.

A revision round includes reasonable adjustments to the presented concept(s), such as color, typography, layout refinements, or minor design changes.

  • Additional revision rounds beyond the included two will be billed at an additional rate.

  • Requests that significantly alter the original direction or require new concepts will be considered out of scope and quoted separately.

4. Client Responsibilities

The Client agrees to:

  • Provide timely feedback, approvals, and required content (copy, images, product details, etc.)

  • Ensure all provided materials are accurate, legally compliant, and owned or properly licensed

  • Communicate clearly and within agreed timelines to avoid project delays

Delays in communication or asset delivery may result in adjusted timelines.

5. Legal & Regulatory Compliance (CPG + Website Disclaimer)

Visual Sugar Creative provides design services only and does not provide legal, regulatory, or compliance advice.

The Client is solely responsible for ensuring that all packaging, labeling, claims, and website content comply with applicable laws and regulations, including but not limited to:

  • U.S. Food and Drug Administration (FDA) requirements

  • Federal Trade Commission (FTC) advertising and marketing guidelines

  • State and federal labeling laws

  • Cannabis, hemp, or CBD regulations (if applicable)

  • Ingredient disclosures, nutritional panels, allergen statements, and health claims

  • Accessibility, privacy, and data collection laws for websites

Visual Sugar Creative is not responsible for verifying or ensuring compliance with any legal or regulatory requirements.

The Client agrees to:

  • Provide all required legal text, disclaimers, and compliance-related content

  • Consult with qualified legal or regulatory professionals when needed

  • Approve all final designs prior to production or publication

By approving final deliverables, the Client accepts full responsibility for all legal compliance.

6. Production & Printing Disclaimer

Visual Sugar Creative may provide guidance on print production, materials, or vendors; however:

  • The Designer is not responsible for errors introduced during printing or manufacturing

  • Final print files must be reviewed and approved by the Client before production

  • The Client is responsible for confirming dielines, materials, and print specifications with their printer or manufacturer

7. Website Disclaimer

Visual Sugar Creative designs and develops websites for visual and functional purposes only.

The Client is responsible for:

  • Legal pages (Privacy Policy, Terms of Service, Cookie Policy, etc.)

  • ADA/accessibility compliance

  • Data protection and privacy compliance (including GDPR, CCPA, or other applicable laws)

  • Any claims made on the website

The Designer is not liable for legal issues arising from website content or functionality.

8. Intellectual Property

  • Final approved designs are licensed to the Client for their intended business use upon full payment.

  • Visual Sugar Creative retains the right to display work in portfolios, social media, and marketing materials.

  • Preliminary concepts, unused designs, and working files remain the property of the Designer unless otherwise agreed.

9. Project Timelines

Timelines are estimated and depend on Client responsiveness.

Visual Sugar Creative is not responsible for delays caused by:

  • Late feedback or approvals

  • Delayed content delivery

  • Scope changes

Extended delays (30+ days of inactivity) may result in project termination or restart fees.

10. Cancellations & Refunds

  • Deposits are non-refundable

  • If a project is canceled after work has begun, the Client is responsible for payment of all work completed up to that point

  • No refunds will be issued for completed or partially completed work

11. Limitation of Liability

Visual Sugar Creative shall not be held liable for:

  • Legal or regulatory compliance issues

  • Loss of profits, revenue, or business opportunities

  • Printing or manufacturing errors

  • Third-party platform issues (Shopify, hosting providers, plugins, etc.)

The Client agrees that the Designer’s total liability shall not exceed the total amount paid for the project.

12. Acceptance of Terms

By engaging in services with Visual Sugar Creative, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
